The Law Society of Kenya has proposed to the National Lands Commission and the Lands Cabinet Secretary to seek the Supreme Court’s guidance in interpreting some of the land laws that has created a stalemate between the two bodies.
This follows revelation by the commission’s Chairman Muhammad Swazuri that the many deliberations the ministry and the commission has had with various government bodies have failed the bear fruits.
“We first went to the Attorney General to seek his interpretation of the law, he gave us his advice, we then went to the CIC, they are yet to give us their response,” lamented Swazuri
Speaking at a media briefing LSK Chairman Eric Mutua stated that the controversy between the Lands CS Charity Ngilu and and the commission needed to be put to rest very quickly to avoid dire economical consequences.
Mutua however warned that the Supreme Court should be the last avenue the two bodies sought to deal with the situation.
The Lands Commission is entitled to move to the Supreme Court for purposes of getting an advisory opinion form the Supreme Court so that this question is laid to rest and the court demarcates what each party is supposed to do” said Mutua.
