Attorney General Prof Githu Muigai is physically present at the international criminal court today,Thursday for the status conference of President Uhuru Kenyatta’s case.
Professor Muigai will be responding to claims that the Kenyan Government has frustrated the office of the prosecutor by failing to allow it to access president Kenyatta’s bank records.
“The court in Kenya will not hear a case where a Prosecutor in America wants phone records. A court order has to be obtained” said Muigai Thursday in the ongoing status conference.
He further told the ICC judges that the government of Kenya does not take legal advice form the prosecution on its obligations as per the treaty, Kenya’s cooperation is subject to the country’s own laws.
The status conference comes after the three international criminal court judges issued a statement that the court will benefit from hearing oral submissions in relation to the application including from the Kenyan government.
The attorney General has however affirmed that the government has cooperated extensively with the prosecutor’s office.
