The court of appeal in Nyeri Thursday nullified the election of Othaya member of parliament Mary Wambui citing many discrepancies.
The appellate court said a certificate nullifying Wambui’s election should be issued to the national assembly with immediate effect setting aside a a judgement by the High Court that declared Wambui as validly elected
The ruling by Justices Alnasir Visram, Martha Koome and Otieno Odek paves way for a by-election just eight months after Wambui was declared an MP in a close contest.
According Justice Visram Othaya constituency elections were not conducted in an accurate and accountable manner adding that Wambui was not duly elected.
“The only way to find the validity of the election was to order a recount of the contentious polling station and scrutinizing the ballot boxes. This was not however done,” Said the judges.
The judges unanimously agreed that petitioner Peter King’ara had valid reasons to appeal Justice Jairus Ngaah’s judgement delivered in September.
