The high Court has ruled that the judicial service commission compensate former chief registrar of the judiciary Gladys Sholei for wrongful dismissal.
Justice Nduma Nderi said the Judical Service Commission would have involved other State Agencies like the Ethics and Anti Corruption Commission and Director of Public Prosecution’s office in developing charges against the alleged corruption.
Shollei was sacked in October last year on allegations of abuse of and misappropriation of Sh2 billion Judiciary funds and has since been replaced by Anne Atieno Amadi.
Justice Nderi also said Chief Justice Willy Mutunga could have been set aside from the disciplinary proceedings against former Chief Registrar of the Judiciary.
The court added that even after biased claims had been raised by Shollei that commissioners would give her impartial hearing, the Judicial Service Act provides that at least three commissioners could still hear the disciplinary proceedings.
